Pursuant to Articles 13 and 14 of EU Regulation 2016/679

To proceed with sending communications via form or registering for services provided on the website www.travelmar.it, we need to acquire some of your data. Therefore, by Articles 13 and 14 of EU Regulation 2016/679, we provide you with the following information:


1. PURPOSE OF DATA PROCESSING AND LEGAL BASIS

1.1 The processing of your data, provided by you through the registration/contact forms on the website, will be carried out as strictly necessary for the provision of the requested services (purchasing travel tickets along with communications related to the purchased service, requesting refunds, requesting commuter passes, using onboard Wi-Fi, and fulfilling legal and/or contractual obligations, as well as fulfilling any obligations provided by regulations or EU law (Article 6, letters b and c of the GDPR)).

1.2 The controller will also use the personal data for administrative and accounting purposes and for the execution of contractual obligations towards users who are part of its customer base, and for the provision of requested services (Article 6, letters b and c of the GDPR).

1.3 To send, if users have consented when activating the service, or consent later, and until its revocation, commercial communications regarding its products and services, or third-party companies, including automated methods, for direct sales purposes, as well as for sending market research and user satisfaction surveys (Article 6, letter A of the Regulation).

1.4 To carry out, if users have consented when activating the service, or consent later, and until its revocation, even through electronic tools, activities for analyzing specific behaviors and consumption habits, to improve the services provided and direct commercial proposals of interest to the user, also offering third parties the personal data and aggregated summary data of opens and clicks obtained through a tracking system using "cookies" (Article 6, letter A of the Regulation).

1.5 The processing of your data will be carried out for operational and strategic marketing purposes and commercial communications, subject to explicit consent (Article 6, letter A of the Regulation).


2. TYPES OF DATA PROCESSED

2.1 The Data Controller processes the following personal data during registration: (first name, last name, IP address, MAC address, physical address, phone contacts, email/PEC address, tax code, VAT number, payment data, special categories of data).


3. DATA PROCESSING METHODS

3.1 The processing and storage of data will be carried out using IT and/or paper-based tools and methods, most suitably to ensure its integrity, security, and confidentiality.
 Personal data is registered and stored in electronic databases located in Italy, in countries belonging to the European Economic Area (EEA), and in third countries that ensure an adequate level of data protection.
 The processing of personal data provided by users may also be carried out by companies, professionals, or agencies appointed as data processors under Article 28 of the aforementioned EU Regulation. These entities, on behalf of the Data Controller, provide specific processing services or related, instrumental, or supporting activities.

 

4. DURATION OF DATA PROCESSING

The retention period for the personal data above is as follows:

●          10 years from the date of termination of the contractual relationship for the purposes outlined in points 1.1 and 1.2.
●          24 months for the purposes outlined in points 1.3, 1.4, and 1.5.


5. KNOWLEDGE AND COMMUNICATION OF DATA

5.1 Your data may be accessed by:
 a) employees and collaborators of the Data Controller;
 b) individuals who carry out technical or organizational activities on behalf of the company (professionals, consultancy firms, and partner companies);
 c) third-party companies, subject to consent;
 d) public authorities, as required by law.


6. DISSEMINATION AND TRANSFER OF DATA

 6.1 Your data will never be disseminated and/or transferred to third parties except for third-party cookies, subject to specific regulations or with explicit consent.

 

7. OBLIGATORY OR OPTIONAL NATURE OF DATA COLLECTION

 7.1 Providing data is mandatory to fulfill legal and/or contractual obligations as specified in points 1.1 and 1.2 of this notice. In contrast, it is optional for commercial and marketing purposes as outlined in points 1.3, 1.4, and 1.5 of this notice.

 

8. CONSEQUENCES OF FAILURE TO PROVIDE DATA

 8.1 Failure to provide personal data will fail to execute the contract and/or the failure to continue the relationship and/or provide the requested services outlined in points 1.1 and 1.2.

 8.2 Providing data for points 1.3, 1.4, and 1.5 is optional.

10. RIGHTS OF THE DATA SUBJECT

The GDPR provides a series of rights for the data subject, specifically the right to access personal data, the right to obtain rectification or deletion of the data or restriction of processing, the right to object to processing, the right to data portability, the right to withdraw consent where applicable: withdrawing consent does not affect the legality of the processing based on consent before its withdrawal; the right to complain with the Privacy Authority.

What are cookies?
